Анотація

У статті проаналізовано ключові етапи та сучасний стан інституціоналізації медіації. На основі якісного аналізу з використанням напівструктурованих глибинних інтерв’ю з експертами-медіаторами окреслено передумови подальшого розвитку медіації як соціального інституту. З’явившись на початку формування ринкових відносин в Україні як сукупність неформальних практик і норм в Україні, згодом медіація перетворилась у формалізовані організаційні структури. Профільний Закон України «Про медіацію» заклав фундаментальну нормативно-правову базу застосування медіації. В українському суспільстві формується мережа освітніх програм, що готують фахівців у сфері медіації (у тому числі на рівні закладів вищої освіти). Важливими заходами для подальшого розвитку медіації в Україні є розробка нормативно-правових документів, які деталізуватимуть застосування процедур медіації в різних сферах суспільного життя; популяризація медіації державними органами й громадськими організаціями; поширення курсів з основ урегулювання конфліктів та медіації у шкільних й університетських програмах; унормування вимог до статусу та кваліфікації медіаторів; запровадження механізмів використання процедури медіації в рамках судочинства.
